Divorce

    In Minnesota, divorces (or dissolution of marriages) are regulated by Minnesota Statutes Section 518.  A dissolution of marriage is "the termination of the marital relationship between a husband and wife."  (518.06).  A dissolution of marriage shall be granted when the court finds that there has been an "irretrievable breakdown of the marriage relationship."  (518.06).  Thus, Minnesota is a "no fault" state for purposes of obtaining a dissolution of marriage. 

    To obtain a dissolution of marriage in Minnesota, one of the parties must have resided in the state of Minnesota for at least 180 days (approximately six months) immediately preceding the commencement of the proceeding.  (518.07).

    To commence dissolution of marriage proceedings, either spouse must have the other spouse personally served with a summons and petition for dissolution of marriage. (518.09).  The other spouse (the one that was served) will have 30 days in which to answer the petition.  (518.12).
