Medical Assistance Transfers, State Intends to
Close Property Transfer “Loopholes”

proposes to make medical assistance planning even more difficult by (a)
reversing the Barg decision; (b) requiring special needs trusts to make
filings and disclosures and annual accountings to DHS; (c) disqualifying
last minute expenditures for medical assistance nursing home applicants;
and (d) barring “half loaf” strategies by requiring return of
transferred assets.

2010 National
Healthcare Law - Individual Health Insurance - Mandate, Subsidy, Penalty

Unless the U.S. Supreme Court rules
the new federal health care law unconstitutional or it is repealed, the
Patient Protection and Affordable Care Act (P.L. 111-148) as amended by
the Health Care and Education Reconciliation Act of 2010 (P.L. 111-152)
will, for the most part, go into effect in 2014. This article
discusses the effects of these changes.
